Carson Concrete Co. accused of failing to pay contributions

PHILADELPHIA – A Boothwyn employer is alleged to have failed to pay contributions to several labor union funds for three years.

The board of trustees of the Laborers' District Council Construction Industry Pension and Annuity Fund, The Laborers' District Building and Construction Health and Welfare Fund, et al. filed a complaint on Nov. 1 in the U.S. District Court for the Eastern District of Pennsylvania against Carson Concrete Co. alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs allege that the defendant has failed to submit remittance reports and failed to pay contributions from November 2014 to the present in violation of a bargaining agreement.

The plaintiffs seek judgment against the defendant in the amount of unpaid contributions, interest, audit fees, costs, attorney's fees, liquidated damages, contributions and deductions due to the plaintiff and any further relief the court grants. They are represented by Joel P. Trigiani of Cleary, Josem & Trigiani LLP in Philadelphia.
