Symphony Health Solutions Corp. files suit over Kentucky company's use of PHAST mark

PHILADELPHIA – A Conshohocken company alleges a Kentucky company is unlawfully using its trademark.

Symphony Health Solutions Corp. filed a complaint on Nov. 6 in the U.S. District Court for the Eastern District of Pennsylvania against American Board of Family Medicine Inc. alleging trademark infringement.

According to the complaint, the plaintiff alleges that it has been using the PHAST mark since early 2001 and that the defendant is also using it and has a pending trademark application. The suit states the defendant began using the mark in 2015.

The plaintiff alleges that the defendant's conduct has caused and will continue to cause it harm if the defendant is not enjoined.

The plaintiff seeks enjoin the defendant from further infringing plaintiff's mark; compensatory, consequential and/or incidental damages, exemplary, and/ or punitive damages; court costs, interest and any further relief the court grants.
