PITTSBURGH – A Pittsburgh pharmacy management software provider alleges a Florida business misappropriated its information to develop a competing product.
SoftWriters Inc. filed a complaint on Nov. 6 in the U.S. District Court for the Western District of Pennsylvania against IND Consulting LLC alleging breach of contract.
According to the complaint, the plaintiff's flagship product is FrameworkLTC and companion products are FrameworkLTC and FrameworkLink. The suit states in February 2010, August 2010 and February 2017, the plaintiff entered into confidentiality agreements with the defendant to assist with data entry and data conversions.
The plaintiff alleges that the defendant's INDView software was developed with the plaintiff's proprietary information.
The plaintiff holds IND Consulting LLC responsible because the defendant allegedly misappropriated plaintiff's confidential information to introduce a product to directly compete with it.
The plaintiff requests a trial by jury and seeks compensatory damages, all profits, punitive and/or exemplary damages, court costs, order the defendant to return and/or permanently destroy any confidential information of plaintiff in its possession, enjoin the defendant and any further relief this court grants.
