PHILADELPHIA – A BitTorrent user known only by his or her Internet protocol address is alleged to have unlawfully distributed 38 adult films.
Strike 3 Holdings LLC filed a complaint on Nov. 17 in the U.S. District Court for the Eastern District of Pennsylvania against John Doe subscriber assigned IP address 73.13.23.217 alleging copyright infringement.
According to the complaint, the plaintiff is the owner of award-winning, acclaimed adult motion pictures.
The plaintiff holds John Doe subscriber assigned IP address 73.13.23.217 responsible because the defendant allegedly used the BitTorrent file distribution network to make unauthorized copies of 38 of plaintiff's motion pictures and distributed them using the same application. The plaintiff alleges it has used IP address geolocation technology to determine the defendant resides in the court's district.
The plaintiff requests a trial by jury and seeks enjoin the defendant, order the defendant to permanently delete all digital medial files relating to plaintiff's works, order the defendant to remove infringing copies of plaintiff's work, statutory damages, court costs and any further relief this court grants.
