Philadelphia Hospital & Health Care Employees union alleges employers owe nearly $40,000

PHILADELPHIA – Two New Jersey employers are alleged to have failed to pay contributions on behalf of their employees to labor union funds.

Philadelphia Hospital & Health Care Employees - District 1199C Training and Upgrading Fund, et al. filed a complaint on Dec. 18 in the U.S. District Court for the Eastern District of Pennsylvania against Innova Atlantic WH Operations LLC, doing business as Deptford Center for  Rehabilitation and Healthcare, also known as Centers for Specialty Care-Deptford; and Innova Atlantic WH Operations LLC, doing business as Hammonton Center for Rehabilitation and Healthcare, also known as Centers for Specialty Care-Hammonton citing the Employee Retirement Income Security Act.

According to the complaint, the defendants were party to a collective bargaining agreement with the National Union of Hospital and Health Care Employees. The suit states a compliance audit was conducted for the period of September 2012 to December 2013 and found the defendants owed $39,881.50. The suit states the defendants disputed this amount, but conceded they did owe $10,278.24. 

The plaintiffs allege the defendants have failed to pay any of the audited amount owed.

The plaintiffs seek judgment in the sum of at least $39,881.50 plus amounts due and owing, interest, liquidated damages, unpaid contributions, court costs and any further relief the court grants. They are represented by Susan A. Murray of Freedman and Lorry P.C. in Philadelphia.
