Woman seeks short-term disability benefits from Life Insurance Co. of North America

PHILADELPHIA – A woman alleges she is disabled from her job as a registered nurse and that her disability benefits were wrongfully denied.

Kimberly Brittingham filed a complaint on Dec. 18 in the U.S. District Court for the Eastern District of Pennsylvania against Life Insurance Co. of North America alleging violation of the Employee Retirement Security Act.

According to the complaint, the plaintiff alleges that she became disabled from her job as a nurse and applied for disability benefits. The suit states the defendant terminated her short-term disability benefits in March.

The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly failed to properly and adequately investigate the merits of her disability claim.

The plaintiff seeks payment of short-term disability benefits due to her, immediate reinstatement, court costs, interest and any further relief the court grants. She is represented by Marc H. Snyder and Kellyanne Inservo of Rosen, Moss, Snyder & Bleefeld LLP in Jenkintown.
