PITTSBURGH – A pension fund is seeking a court's help in determining the beneficiary of a pension plan.
United States Steel and Carnegie Pension Fund filed a complaint on Jan. 31 in the U.S. District Court for the Western District of Pennsylvania against John P. Readal, executor of the estate of Gerald J. Readal; Frances S. Readal and Rosemary A. Booth seeking declaratory relief.
According to the complaint, Gerald J. Readal is a former United States Steel Corp. employee who died in April 2017 in Allegheny County and participated in the plaintiff's plan. The suit states that upon the death of a participant in the plan, the assets should be distributed to the beneficiary or beneficiaries. The plaintiff alleges Frances S. Readal was listed as Gerald J. Readal's beneficiary in a form dated 1996.
The suit states all of the defendants have made claims for the assets of the account. It is seeking the court's assistance to adjudicate the claims.
The plaintiff seeks permission to allow it to convert to cash and pay into the court's registry all the assets of the account of Gerald J. Readal under the plan, restrain the defendants and other claimants from instituting or prosecuting in any other court any proceeding against the plaintiff, discharge the plaintiff from all other liability to the defendants and any further relief this court grants. It is represented by Samuel F. Reynolds Jr. and Anthony T. Cicchino of United States Steel Corp. in Pittsburgh.
