Synchrony Bank accused of accessing individual's credit report in attempt to collect discharged debt

PHILADELPHIA — An individual is suing Synchrony Bank for allegedly accessing his credit report when it allegedly did not have the right to do so.

Von Brooks filed a complaint on April 10 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendant violated the Fair Credit Reporting Act (FCRA).

According to the complaint, the plaintiff alleges that he filed for Chapter 7 bankruptcy on June 18, which included his debt to the defendant. Despite allegedly knowing that the plaintiff had discharged his debt, the defendant allegedly accessed his credit report in an alleged attempt to collect the debt, which the plaintiff claims was a violation of the FCRA.

The plaintiff holds the defendant responsible for allegedly requesting and obtaining his credit report without a permissible purpose.

The plaintiff requests a trial by jury and seeks actual and statutory damages, punitive damages, costs of the suit, attorney's fees and any further relief the court deems just and proper. He is represented by Stephen M. Dunne of Dunne Law Offices PC in Philadelphia.
