Melmark accused of firing woman for allegedly exercising her rights under the FMLA

PHILADELPHIA — An individual is suing her former employer, Melmark Home Inc. d/b/a Melmark, for alleged disability discrimination, retaliation and wrongful termination.

Victoria Hayes filed a complaint on April 25 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendant violated the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that she was fired from her job for going on FMLA-protected leave. As a result, she claims that she has suffered monetary damages and mental anguish. The plaintiff holds the defendants responsible for allegedly refusing to allow her 12 weeks of FMLA leave.

The plaintiff requests a trial by jury and seeks compensatory and liquidated damages, attorney's fees, costs, interest and any other proper or equitable relief. She is represented by David M. Koller of Koller Law LLC in Philadelphia.
