Adjusters set to pursue 12 percent contingency fee in arbitration hearing this month

PHILADELPHIA – An arbitration hearing is set for later this month in a case featuring an insurance adjustment firm seeking its contracted 12 percent contingency fee, in an underlying matter concerning a property loss.

The hearing is set for June 25 in the Arbitration Center at 1880 JFK Boulevard in Center City, Philadelphia.

Phoenix Public Adjusters of Bensalem initially filed suit in the Philadelphia County Court of Common Pleas on July 19, 2017 versus Robert and Judy Traina, of Philadelphia.

Per the lawsuit, on July 23, 2015, defendants retained plaintiff to advise and assist them in the presentation of an insurance claim filed with defendant’s carrier, American Modern Home Insurance Company. In consideration of plaintiff’s assistance, defendants contracted to pay a 12 percent contingent fee, specifically, that plaintiff would be paid ’12 percent of the amount paid by the insurance company for this loss,” the suit said.

“American Modern Home Insurance Company issued payment in the amount of $113,000, as payment for this loss. Plaintiff’s final fee for this claim was $13,560. To date, no payment has been made by defendants, despite multiple attempts by plaintiffs to contact them and secure payment,” the suit added.

For a lone count of breach of contract, the plaintiff is seeking damages of $13,560, plus interest and court costs.

The plaintiffs are represented by Anthony DiUlio of the Law Offices of Jonathan Wheeler, in Philadelphia.
