Arbitration hearing pending for reimbursement case against Nationwide Insurance Company

PHILADELPHIA – An arbitration hearing has been set for a case pitting a policyholder against Nationwide Insurance Company policyholder, with the latter alleging the provider has not reimbursed him for money he expended in connection with repairing damage to his property last year.

The hearing is set for June 26 in the Arbitration Center at 1880 JFK Boulevard in Center City, Philadelphia.

Nicholas Rivelli of Horsham filed suit in the Philadelphia County Court of Common Pleas on July 18, 2017 versus Nationwide Insurance Company of Des Moines, Iowa.

According to the lawsuit, Rivelli was listed as having an insurance policy from Nationwide which covered his property in Horsham. During the time he held the policy, on April 5, 2017, Rivelli suffered a loss and damage to his property, a circumstance he reported to Nationwide in a timely manner.

Rivelli asserted Nationwide has not reimbursed him for the loss to his property without cause or legal justification, despite numerous requests and demands to do so, and that this inaction from Nationwide constituted both breach of contract and bad faith.

For those same counts of breach of contract and bad faith, the plaintiff is seeking damages not in excess of $50,000.00, plus statutory damages including interest from the date when the claim was made in an amount equal to the prime rate of interest plus three percent, court costs, attorney’s fees, delay damages, punitive damages and compensatory and/or consequential damages.

The plaintiffs are represented by Anthony DiUlio of the Law Office of Jonathan Wheeler, in Philadelphia.

The defendant is represented by Pamela A. Carlos and Lily K. Huffman of Bennett Bricklin & Saltzburg, also in Philadelphia.
