Allstate accuses Broan NuTone, Jakel of negligence following fire

PHILADELPHIA — An insurance company is suing Broan Nutone LLC and Jakel Motors Inc., citing alleged negligence, strict liability and breach of warranty.

Allstate Property and Casualty Insurance Co. filed a complaint July 3 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants manufactured and distributed a defective exhaust/ventilation fan.

According to the complaint, on Aug. 8, 2017, Tracy and Jarrett Harris' property was damaged after a fire broke out from their second-floor master bathroom where the exhaust fan purchased from the defendants was installed.

The plaintiff requests a trial by jury and seeks an amount in excess of $200,000, costs of the lawsuit, delay damages, attorney's fees and other reasonable relief deemed proper by the court. It is represented by Jeffrey Zielinski of de Luca Levine LLC in Blue Bell.
