Healthy Minds Academy claims fellowship used its name to get grants

PITTSBURGH — The Healthy Minds Academy is suing Albert Schweitzer Fellowship-Pittsburgh, citing alleged misappropriation of and idea and trademark infringement.

The academy filed a complaint July 12 in the U.S. District Court for the Western District of Pennsylvania, alleging that the defendant obtained funds through unfair and deceptive means.

According to the complaint, the academy's applications for grants from at least two organizations, including the PNC Charitable Foundation and McCauley Ministries, were denied. The academy alleges the defendant fraudulently applied for and received grants by using the plaintiff's name and curriculum, causing it to lose grants and suffer damage to its reputation among its donor base. 

The plaintiff said the defendant also obtained profit at the academy's expense.

The plaintiff requests a trial by jury and seeks a judgment including injunctive relief, compensatory and economic damages, court costs and attorney’s fees. It is represented by Danielle Parks of Kraemer, Manes & Associates LLC in Pittsburgh, Pennsylvania.
