Consumer sues retail electric provider, claiming nuisance telemarketing practices

PHILADELPHIA — A consumer has filed a class-action lawsuit against Texpo Power, doing business as YEP Energy, a retail electric provider, citing alleged intrusive invasion of privacy.

Andrew Perrong, on behalf of all others similarly situated, filed a complaint on July 27, in the U.S. District Court for the Eastern District of Pennsylvania, against Texpo Power, alleging that the retail electric provider violated the Telephone Consumer Protection Act.

The plaintiff alleges that on July 13, 2018, he began receiving pre-recorded message from defendant without identifying the party that was calling. The plaintiff was temporarily deprived of legitimate use of his phone and his privacy was invaded. 

The plaintiff holds Texpo Power responsible, because the defendant allegedly placed calls using a pre-recorded message and without plaintiff's prior express consent.

The plaintiff requests a trial by jury and seeks an order certifying this action as a class action and appointing plaintiff and his counsel as representatives, award for damages and such other necessary, just and proper relief.
