Couple blames Essroc Ready Mix, Hanson Ready Mix for man's burns

PHILADELPHIA — Two Ohio residents are suing Essroc Ready Mix Corp., doing business as Hanson Ready Mix Inc., Lehigh Hanson Inc. and Essroc Cement Corp., doing business as Lehigh Hanson ECC Inc., citing alleged loss of consortium, breach of implied warranty a nd breach of express warranty.

Larry Alltop and Gloria Alltop filed a complaint Aug. 9 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants manufactured and delivered an unsafe product.

According to the complaint, Larry Alltop was sprayed by concrete being delivered by the defendants on Aug. 9, 2016. The Alltops claim the concrete burst out of the truck when it came down the chute and spilled onto Larry Alltop's pants and shoes, resulting in second-degree and third-degree burns.

The plaintiffs allege that Larry Alltop incurred more than $76,000 in medical treatment and hospital expenses, plus physical injuries and mental anguish.

The plaintiffs request a trial by jury and seek an amount in excess of $76,000 plus pre-judgment and post-judgment interest, punitive damages, attorney's fee and costs of the lawsuit. Gloria Alltop also demands a $25,000 judgment against the defendants.
