Manager claims she was terminated by Injured Workers Pharmacy due to disability

PHILADELPHIA — A manager is suing a pharmacy, citing alleged age and disability discrimination, retaliation and wrongful termination.

Eileen Segar filed a complaint on Oct. 8 in the U.S. District Court for the Eastern District of Pennsylvania against Injured Workers Pharmacy LLC, alleging violation of the Americans with Disabilities Act, Age Discrimination in Employment Act, and Human Relations Act.

According to the complaint, on Dec. 3, 2012, Eileen Segar was hired by defendant as a business development manager, providing prescriptions to injured persons. 

in February 2016, she was diagnosed with esophageal cancer, which required surgery. She claims she informed defendant of her condition and was approved for medical leave. However, on July 6, 2016, when she returned from work, she allegedly was subjected to discrimination and retaliation on the basis of a qualified disability and age, ultimately leading to her discharge. 

The plaintiff holds Injured Workers Pharmacy responsible for alleged unlawful use of plaintiff's known disability as a motivating factor in taking discriminatory, harassing and retaliatory actions, ultimately culminating in her termination of employment.

The plaintiff requests a trial by jury and seeks declaratory and injunctive relief, award of damages, attorney fees, costs, and grant such other relief as the court deems just and proper, all of which is in excess of $150,000. She is represented by Edith Pearce of The Pearce Law Firm PC in Philadelphia.
