Penthouse customer claims its staff beat him and broke his jaw in brutal assault

PHILADELPHIA – A gentleman’s club patron claims he was brutally assaulted by the club’s staff, who allegedly attacked him without provocation and left him bloody and beaten outside with a broken jaw.

Yuriy Volosyuk of Philadelphia filed suit in the Philadelphia County Court of Common Pleas on Aug. 14 versus The Penthouse Club and its management entities.

“At or about 9:30 p.m. on Aug. 29, 2016 until at or about 1 a.m. Aug. 30, 2016, plaintiff Yuriy Volosyuk was a lawful patron of defendants at the Penthouse Club located at 3001 Castor Avenue, Philadelphia, PA 19134. While seated near the stage area of the premises, plaintiff was accosted, without provocation, by defendants, by and through their agents, servants, workmen, employees, and/or other representatives, who lifted him from his chair by his neck causing him to lose consciousness,” according to the lawsuit.

“While unconscious, defendants, by and through their agents, servants, workers, employees, and/or other representatives struck plaintiff when plaintiff was unable to defend himself, prevent himself from falling after being struck, or to ascertain why he was being struck. Plaintiff regained consciousness while on the ground outside the front doors of the premises, covered in blood and having sustained a broken jaw.”

Volosyuk alleged the club possessed surveillance video of the altercation, but failed to preserve that evidence. Among numerous other charges, Volosyuk accuses the defendants of failing to provide proper and adequate security, failing to have proper staffing, failing to provide proper and adequate surveillance and having inadequate and untrained staff and/or personnel.

The nightclub has not yet filed a response to the litigation, according to Court records.

For counts of negligence, assault and battery, the plaintiff is seeking compensatory and punitive damages, in excess of $50,000, plus interest, costs, attorneys’ fees and any other appropriate relief the Court deems fit.

The plaintiff is represented by Marina Kats and Ryan Anderson of Kats Jamison & Associates, in Feasterville.

The defendants are represented by Brian P. Corcoran and Nicole Ann Jensen of Reilly Janiczek & McDevitt, in Philadelphia.
