Paralyzed Florida man claims business is not compliant with ADA

PHILADELPHIA — A Broward County, Florida, resident is suing a business owner, citing alleged disability discrimination.

Owen Harty filed a complaint on Nov. 13 in the U.S. District Court for the Eastern District of Pennsylvania against Jacob Singer, as trustee of the Michael Singer 2005 GST Exempt Trust, alleging violation of the Americans with Disabilities Act.

According to the complaint, Harty, a paralyzed individual who uses a wheelchair, visited defendant's business and claims he encountered architectural barriers that discriminated against him on the basis of his disability and endangered his safety. Plaintiff also claims noncompliance with the ADA prevented him from retiring to the property to enjoy the goods and service available to the public. 

The plaintiff requests a trial by jury and seeks declaratory judgment and injunctive relief, award of attorney fees, costs, litigation expenses and other relief. He is represented by John Ward and Thomas Bacon of Thomas B. Bacon PA in Wayne.
