Action against Radisson Hotel and Valley Forge Convention Center dismissed through Judgment of Non Pros

PHILADELPHIA – According to Court records, a lawsuit initiated by a Philadelphia woman versus the Radisson Hotel and Valley Forge Convention Center in King of Prussia was dismissed for a failure to prosecute.

On Oct. 17, Philadelphia County Court of Common Pleas Judge John M. Younge ordered Valerie Wright’s case against the hotel and convention center’s management entities would be dismissed through a Judgment of Non Pros.

Wright of Philadelphia first filed suit in the Philadelphia County Court of Common Pleas through a writ of summons filed on Feb. 13 against Radisson Hotel Valley Forge of King of Prussia, Valley Forge Convention Center Partners, L.P. of Wayne, Valley Forge Convention Center Partners, GP, LLC at the Circa Center and G.F. Management, LLC, both of Philadelphia.

Wright did not immediately file a complaint against the defendants and on Feb. 21 and March 14, respectively, Gerard F. Lipski and Anthony R. Deluca, counsel for the defendants, each filed praecipes for rule to file a complaint – requesting rules be entered compelling the plaintiff to file a complaint within 20 days of the rule’s service, or for her to suffer a Judgment of Non Pros.

At a rescheduled case management conference on July 27, Wright appeared but plaintiff counsel John J. Branigan did not. Then on Aug. 2, Judge Arnold L. New called for a rule returnable meeting to be held on Aug. 22, in order for to counsel to show cause why the matter should not be dismissed for failure to prosecute and failure to file a complaint in a timely manner – but which was later rescheduled to Oct. 17.

On Aug. 20, now-former plaintiff counsel John J. Branigan filed a praecipe to withdraw as Wright’s representation, which was later granted prior to the Judgment of Non Pros being entered on Oct. 17.

The defendants were represented by Gerard F. Lipski of Campbell Lipski & Dochney, plus Anthony R. Deluca of Styliades Mezzanotte & Hasson, also both in Philadelphia.
