State Farm seeks more than $100,000 from solar panel contractors for fire damage

HARRISBURG — An insurance company is suing Home ReNu and Jonathan Gyger, contractors, citing alleged breach of contract, breach of implied warranty and negligence.

State Farm Fire & Casualty Co., a/s/o Donald Kline, filed a complaint on Jan. 21 in the U.S. District Court for the Middle District of Pennsylvania against the defendants, alleging they failed to safely, properly and adequately install solar panels at Kline's property in New Oxford.

According to the complaint, on Feb. 12, 2018, Kline entered into a contract with ReNu for the installation of solar panels at the subject property. On July 22, 2018, a fire erupted at the subject property due to the alleged improper installation of the solar panels. 

The plaintiff holds Home ReNu and Jonathan Gyger responsible because the defendants allegedly failed to properly perform the installation. State Farm also claims ReNu improperly selected and inadequately supervised Gyger, giving rise to the damages at the subject property.

The plaintiff seeks an amount in excess of $100,000 plus interest, costs of suit, reasonable attorney fees, delay damages, and such other relief as the court deems proper. It is represented by Daniel de Luca of de Luca Levine in Blue Bell.
