PHILADELPHIA – A consumer alleges a Houston-based energy provider unlawfully called him for telemarketing purposes.

Jon Frey, individually and on behalf of all others similarly situated, filed a complaint on April 29 in the U.S. District Court for the Eastern District of Pennsylvania against Titan Gas LLC, doing business as Titan Gas and Power, alleging violation of the Telephone Consumer Protection Act and unfair trade practices.

The plaintiff alleges on Feb. 18, the defendant made a pre-recorded telemarketing call to his residence in violation of the TCPA. He alleges he did not consent to receive the call and that he was injured because the calls were annoying, a nuisance and disturbed his solitude.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Clayton S. Morrow of Morrow & Artim PC in Pittsburgh.
