PHILADELPHIA – A Downington voice and data communications products provider is alleged to have sent unsolicited faxes advertising its products.
Lap Distributors Inc., individually and on behalf of all others similarly situated, filed a complaint on May 23 in the U.S. District Court for the Eastern District of Pennsylvania against Quadisco Inc., doing business Quadis Voice & Data Solutions, citing the Telephone Consumer Protection Act and the Junk Fax Prevention Act.
According to the complaint, the plaintiff alleges on Oct. 23, 2018, the defendant sent an unsolicited ad to the plaintiff without its consent or having a previous relationship.
The plaintiff alleges its counsel notified the defendant that it was in violation of the Telephone Consumer Protection Act by sending the fax and offered to settle its claims, but the defendant did not respond and sent a second unsolicited fax in January.
The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Adam T. Savett of Savett Law Offices LLC in Allentown.
