Worker allegedly injured in fall from lift on State Correctional Institution-Forest project files lawsuit

PITTSBURGH – A Lewis Run man who allegedly sustained spinal cord injuries in a fall from a scissor lift has filed a lawsuit against several entities associated with the lift and the project he was working on, seeking damages.

Daniel Popiel filed a complaint Aug. 16 in the Allegheny County Court of Common Pleas against Genie Industries Inc., Terex Corp., GM Equipment Corp. and North Central Mechanical Inc. alleging negligence and strict liability.

According to the complaint, on March 20, 2018, the plaintiff was operating a scissor lift to install PVC fitting covers on hot water pipes at State Correctional Institution-Forest as an employee of Allegheny Industrial Insulation. The suit states North Central Mechanical was the contractor on the project.

The suit states as the plaintiff was operating the lift, which was rented from GM Equipment and manufactured by Genie, the guardrail system failed to restrain him and he fell 21 feet to the ground and sustained spinal cord injuries.

The plaintiff is seeking all reasonable sums due and court costs. The plaintiff is represented by David L. Kwass of Saltz, Mongeluzzi, Barrett and Bendesky in Philadelphia and Shawn K. Kressley of Delvecchio & Miller LLC in Pittsburgh.
