Pedestrian struck by car sues Township of Haverford, says traffic light was broken

MEDIA – An Upper Darby woman struck by a vehicle while trying to cross an intersection in the Township of Haverford alleges the pedestrian traffic control signal was malfunctioning at the time of the collision.

Saadia Bendaraz filed a complaint in the Court of Common Pleas of Delaware County against the Township of Haverford, Higgins Electrical Contractors Inc., Earl Childs III and Childs Electric alleging negligence. 

The suit states Bendaraz was walking across the intersection of Landsdowne Avenue and Darby Road in Delaware County on Oct. 15, 2018, when she was struck by a Dodge Caravan operated by Childs. Bendaraz suffered fractures and other injuries. 

She alleges the signal, which Higgins Electric was contracted to maintain, was malfunctioning and only cycled through a flashing red hand and no signal at all. She alleges Higgins and the township had knowledge the signal was not functioning properly and failed to service the signal. 

Bendaraz seeks damages, interest and other just relief. She is represented by Joshua Kirsch and Michael Sabatina of The Killino Firm PC in Philadelphia.
