Genus Lifesciences alleges Mallinckrodt Pharmaceuticals misappropriated trade secrets

PHILADELPHIA – Allentown-based Genus Lifesciences alleges a supplier misappropriated its trade secrets for a cocaine hydrochloride anesthetic solution.

Genus Lifesciences Inc. filed a complaint Nov. 29 in the U.S. District Court for the Eastern District of Pennsylvania against Mallinckrodt LLC and SpecGx LLC alleging misappropriation of trade secrets under the Defend Trade Secrets Act of 2016 and breach of contract.

According to the complaint, Genus, a specialty pharmaceutical company that develops commercialization of generic and branded pharmaceutical products, developed a cocaine hydrochloride anesthetic solution used by doctors for nasal procedures, which was approved by the Federal Food & Drug Administration (FDA) in December of 2017. 

The suit states the plaintiff entered into an agreement with Mallinckrodt for the defendant to supply raw cocaine hydrochloride material for the plaintiff's product.

Genus alleges that Mallinckrodt misappropriated its trade secrets by giving Gensus' competitor letters of authorization. Genus also alleges Mallinckrodt's actions violated the parties' contract. 

Genus seeks damages, a trial by jury, interest and all other just and equitable relief. They are represented by Travis Gery of K&L Gates LLP in Harrisburg.
