Lifeguard says she was attacked in Monroeville, files lawsuit

PITTSBURGH – A former LA Fitness lifeguard who was allegedly attacked has filed a negligence lawsuit against a gym, a home for individuals with mental illnesses and her alleged attacker. 

Jane Doe filed a complaint Dec. 2 against Serenity Personal Care Home, LA Fitness International, Matthew Beck and others, alleging negligence.

According to the suit, Serenity Care and LA Fitness had a contract to let Serenity residents use the gym's facilities.

Doe was working as a lifeguard at the LA Fitness in Monroeville on June 11, 2018, and alleges Beck, a resident at Serenity Care who had a history of violent behavior, grabbed her breast and buttocks, and began yelling that he wanted to have sex with her. 

She claims he then tried to pull down her pants and hit her in the face, causing her to fall. Beck was arrested at the scene after the alleged attack, according to the suit.

The plaintiff alleges her injuries and damages were solely caused by the defendants' negligence and carelessness.

Doe seeks monetary relief, a trial by jury, interest and all other just relief. She is represented by Steven Barth in Pittsburgh and Jonathan Gesk in Carnegie.
