Personal injury lawsuit involving pretzel company's high-speed dough mixer is transferred to federal court

SCRANTON — An Illinois company has removed a personal injury lawsuit from the Cumberland Court of Common Pleas to federal court.

Cody Staub, of Gettysburg, sued ProXES, of Mundelein, Illinois, on Jan. 10, as a result of injuries he sustained Jan. 11, 2018, while working on a temporary basis for Wege Pretzel Co. of Hanover. 

According to his initial complaint, Staub’s right arm got caught between plastic scrapers and the side of a mixing drum on a ProXES commercial high-speed dough mixer, causing “severe and permanent injuries, including multiple fractures to his dominant arm, hand and wrist.”

On Feb. 14, ProXES filed a motion removing Staub’s complaint to the U.S. District Court for the Middle District of Pennsylvania. Staub’s initial complaint sought a judgment of at least $50,000, but ProXES said his allegations “of severe injuries along with pain and suffering” led it to “reasonably and intelligently concludes that the amount in controversy in this case is well in excess of the $75,000 jurisdictional threshold.”

That, along with fact ProXES is an Illinois corporation, means the complaint should be handled in a federal court, the company concluded.
