America's Benefit urges court to confirm $800,000 arbitration against former shareholder

PITTSBURGH – America’s Benefit seeks to confirm an $803,000 arbitration amount in its case against a former one-third shareholder in the company.

The Allegheny Court of Common Pleas received the petition March 16 in which two shareholders sued concerning Thomas L. Yakopin's conduct. The petition alleges that as a result of Yakopin’s behavior, America’s Benefit filed an injunctive relief to order Yakopin to reimburse it for commissions he received from the company. Yakopin then demanded arbitration, which was approved.

An arbitrator determined Yakopin breached an oral Consolidation Agreement, and his fiduciary duties amid his role as an America’s Benefit director and officer. The arbitrator entered an award of $803,750 against Yakopin that America’s Benefit now hopes to confirm.

It is alleged that Yakopin has yet to pay any of the money he was ordered. America’s Benefit wants the court to step in and enter judgment for the awarded amount against Yakopin, along with any other related court costs.

Plaintiff is represented by Douglas Hart, Joshua Brown and Courtney Brennan with Burns White LLC of Pittsburgh. 

The Allegheny Court of Common Pleas case number is GR-20-4208.
