In a dramatic legal move, a former employee has filed a lawsuit against his previous employer, alleging significant unpaid wages and violations of state labor laws. The complaint was filed by Dariusz Kot in the Court of Common Pleas of Allegheny County, Pennsylvania, on May 1, 2025. The defendants named in the case are LogisticX Inc., a Wisconsin-based transport company, and Mark Kiela.

The lawsuit stems from Mr. Kot's employment with LogisticX Inc., where he worked as a freight transporter under an Employment Agreement starting January 1, 2021. According to the complaint, LogisticX and its representative Mark Kiela failed to pay Mr. Kot for his services adequately. The plaintiff claims that this failure constitutes a breach of the Pennsylvania Wage Payment and Collection Law (WPCL), specifically citing violations under 43 P.S. § 260.1 et seq.

Mr. Kot alleges that during his tenure at LogisticX, he was promised weekly payments ranging from $1,500 to $2,000 based on a percentage of the gross revenue from his deliveries. Despite this agreement, Mr. Kot asserts that he was not paid according to these terms and did not receive any compensation for the final weeks of his employment before it ended around September 1, 2024.

In addition to unpaid wages, Mr. Kot claims he was entitled to reimbursements for travel expenses such as fuel and tolls but did not receive them consistently or accurately as reflected in the company's records labeled "Driver’s Earning." He further alleges discrepancies between the amounts recorded on earnings sheets and what was actually deposited into his account.

The complaint details how LogisticX's actions have left several installments of wages unpaid well beyond the stipulated time frame set by law—15 days after the end of each weekly pay period—thereby violating WPCL provisions. Consequently, Mr. Kot is seeking relief through court judgment against LogisticX Inc., including all unpaid wages, liquidated damages amounting to twenty-five percent of total owed wages or five hundred dollars (whichever is greater), reasonable attorney fees, costs incurred due to litigation efforts under WPCL statutes.
