Driver in I-76 accident blames Turnpike Commission for improper guardrail installation

PITTSBURGH — A man is suing Allegheny County, the Pennsylvania Turnpike Commission and others claiming an improperly installed guardrail on Interstate 76 caused his injuries from an automobile accident. 

Anthony Burgos filed a complaint April 7 in the Allegheny Court of Common Pleas against Penn Line Service Inc., Allegheny County, the Pennsylvania Turnpike Commission, and others alleging negligence and strict products liability.

Burgos was driving his Nissan Maxima on I-76 West early in the morning on April 10, 2018 with his girlfriend and their two minor children as passengers. He alleges that after hitting a patch of black ice on the road, the car struck a guardrail that — due to its improper installation — speared through the passenger side of the car and crushed his leg. 

Burgos seeks monetary relief of more than $35,000, interest and all other just relief. He is represented by Robert Mongeluzzi, David Kwass and Elizabeth Bailey of Saltz Mongeluzzi & Bendesky in Philadelphia.
