Woman who broke hip after fall at Clarks Summit restaurant claims negligence

SCRANTON — A woman who allegedly suffered a broken hip and other injuries at a Japanese restaurant in Clarks Summit is claiming negligence. 

Kathryn M. Berman filed a complaint June 22 in the Court of Common Pleas of Lackawanna County against Kyoto 570 LLC doing business as Kyoto Fine Japanese Cuisine alleging negligence. 

According to her complaint, Berman, who is 77 years old, was dining at the Japanese Cuisine restaurant on South State Street in Clarks Summit on Nov. 9, 2020. She alleges that she was seated, and got up to move another chair when she fell off an interior step and "violently" landed to the ground on her hip. 

Berman claims she suffered a shattered hip and also struck her head and injured her wrist, arm, neck and lower back and chipped her upper teeth. She also claims she underwent hip surgery on Nov. 10, 2020, and has incurred more than $8,600 in medical bills. 

She alleges the defendant's negligence for failing to properly inspect and maintain their premises and for failing to remove or repair the "unreasonably unsafe and dangerous condition." Berman further alleges the defendants negligently  allowed the premises to remain in "a state of disrepair" without warnings or barricades. 

Berman seeks monetary relief of more than $50,000, trial by jury and all other just relief. She is represented by attorney Michael Kenny in Scranton.
