Allegedly stuffing rags in water leak puts landlord in court

PITTSBURGH — A hair salon operator in McKeesport claims her landlord used rags and other material instead of properly fixing a roof water leak that led to her exposure to toxic mold and developing obstructive lung disease. 

Denisha Daye filed a complaint June 15 in the Court of Common Pleas of Allegheny County against Scott Milne alleging negligence. 

Daye entered into a lease agreement with Milne on June 1, 2011, and operated a hair salon on the premises in East McKeesport through February of 2021, according to her suit. She alleges that in November of 2020, she experienced chest tightness and wheezing and was diagnosed by her medical doctor as having "obstructive lung disease consistent with bronchial asthma." 

Daye further alleges that she sought treatment in January of 2021 and that her physician suggested mold may be "contributing to her breathing problems." She claims that in February of 2021, a mold and air testing assessment on her salon found "toxic high-moisture mold" which was caused by a water leak on the roof of her leased premises. Daye alleges Milne failed to repair the roof and leak and "stuffed rags and other material into the leaking space to absorb the leaking water to avoid repair costs. 

Daye seeks monetary relief and all other proper relief. She is represented by Mark Ulven of Sommer Law Group PC in Pittsburgh.
