Bath & Body Works faces class action over credit, debit card numbers printed on receipts

PITTSBURGH — Bath & Body Works is facing a class action lawsuit over its alleged printing of more than the last five digits of customers' credit/debit card numbers on its paper receipts. 

Melinda S. Smidga and Ashley Popa, individually and on behalf of all others similarly situated, filed a complaint Aug. 3 in the Court of Common Pleas of Allegheny County against Bath & Body Works Inc., frequently known as L Brands Inc., alleging violation of the Fair and Accurate Credit Transactions Act (FACTA) and other claims. 

The plaintiffs allege in their class action that Bath & Body Works failed to protect from identity theft and credit and debit card fraud by printing more than the last five digits of their card number on paper receipts in violation of FACTA. 

Specifically, Smidge claims that she made purchases at the Bath & Body Works at The Waterfront on Bridge Street in Homestead on Aug. 2, 2021, and that her paper receipt displayed the first six and last four digits of her personal debit/credit card. 

Also according to the complaint, Popa made purchases at the Bath & Body Works at Boardman Park in the Boardman Township, Ohio, and was presented with a paper receipt that displayed the first six and last four digits of her credit/debit card. The plaintiffs allege that Bath & Body Works had "several years" to comply with FACTA regulations but continues to print the card numbers which has put consumers at risk of identity theft and credit/debit card fraud. 

The plaintiffs seek monetary relief, trial by jury and all other proper relief. They are represented by Gary Lynch and Kelly Iverson of Carlson Lynch LLP in Pittsburgh.
