Upper Darby sued after bench at bus stop collapses

MEDIA — A man who suffered injuries when a bench he was sitting on outside an Upper Darby business allegedly collapsed as he waited for the bus is claiming premises liability. 

Orzel Whitting filed a complaint Aug. 4 in the Court of Common Pleas of Delaware County against 69th Street Retail, 69th Street GP II, LLC and the Township of Upper Darby alleging premises liability. 

Whitting alleges that in January 2020, as he sat down on the bench seat waiting for the bus, the bench collapsed and caused him to fall to the ground. Whitting claims he suffered "severe and permanent" injuries" as a result of the bench collapse including disc protrusion, lumbar radiculopathy, cervical sprain, aggravation of a pre-existing condition and other injuries. 

He alleges the defendants' negligence for failing to monitor and inspect their premises or to barricade or block-off the defective and dangerous area. Whtting also alleges the defendants failed to maintain and repair the bench or warn of the hazard. 

Whtting seeks monetary relief of more than $50,000 and all other just relief. He is represented by Marc Greenfield of Spear, Greenfield, Richman, Weitz & Taggart PC in Philadelphia.
