'Fright Night' scare turns into lawsuit when frightened woman hits face on wall

PITTSBURGH — A woman alleges an employee at an amusement park who was attempting to scare patrons jumped out in front of her and caused her to hit her face against a wall.

Sippora A. Scales filed a complaint Sept. 15 in the Court of Common Pleas of Allegheny County against Festival Fun Parks LLC doing business as Kennywood Park, The Palace Entertainment Inc., and others alleging liability and negligence. 

Scales was walking through the defendant's amusement park Noah's Ark attraction on Oct. 26, 2019, according to her complaint, during a "Fright Night" event to celebrate Halloween. 

She claims that an employee "completely shrouded in black" was hiding in an attempt to scare patrons and then jumped out in an area without any "natural illumination." Scales alleges the employee jumping out in an attempt to scare her caused her to turn and strike her eye and face on the corner of a wall inside the attraction. 

She claims she suffered a laceration and contusion above below her eye, a head injury, scarring, blurred vision and other injuries. Scales further claims the defendants' negligence for failing to train their actors/employees and for failing to have proper safety protocols such as adequate lighting around the attraction. 

Scales seeks monetary relief, trial by jury and all other just relief. She is represented by Michael Metro and James Villanova of The Villanova Law Offices PC in Pittsburgh.
