Lawsuit: Woman injured by protruding metal piece on clothing rack at Victoria's Secret

PITTSBURGH — A couple allege the wife suffered serious injuries after tripping over a metal piece on the bottom of a clothing rack at a Victoria's Secret store. 

Anna Marie Hofer and Glenn Hofer filed a complaint Sep. 23 in the Court of Common Pleas of Allegheny County against Bath & Body Works Inc., frequently known as L Brands Inc., Victoria's Secret, Victoria's Secret & Co., and others alleging negligence. 

The plaintiffs allege that Anna Hofer was shopping at the Victoria's Secret at the Galleria at Pittsburgh Mills on Dec. 23, 2019. They claim that as she was walking around a rack of clothes, a piece of metal protruding from the bottom of the rack caused her to fall and hit her knee on the marble/tile floor. 

The plaintiffs allege that Anna Hofer suffered injuries to her knee which required surgical repair and incurred medical treatment costs. They further allege the defendants placed the clothing racks too close together to allow customers to safely manuever around them and failed to train their employees to properly arrange the racks and displays. The plaintiffs claim the defendants also failed to notice the metal piece on the bottom of the rack which caused a hazard and violated ADA requirements by narrowing the accessibility through the store. 

The plaintiffs seek monetary relief, trial by jury and all other just relief. They are represented by Douglas Olcott of Edgar Snyder & Associates LLC in Pittsburgh.
