Laborer alleges interference with investigation into his on-the-job injury

LANCASTER — A laborer for Mar-Allen Concrete alleges the company is hindering his investigation and legal recourse into an on-the-job injury accident with a cut-off saw. 

Tyquan Osborne filed a complaint Sept. 22 in the Court of Common Pleas of Lancaster County against Mar-Allen Concrete Products.

According to his complaint, Osborne was working as a laborer with Mar-Allen Products on Oct. 4, 2020. He alleges that he suffered a foot laceration with the defendant's Stihl cut-off saw and is now investigating whether to file complaints against the saw's manufacturer, designer and any other third parties. 

Osborne further claims that Mar-Allen has ignored his requests for documents and information that relate to his accident as well as a request to inspect the power tool which were sent in May and June of 2021. He alleges that as a result of the defendant not cooperating, he is unable to issue subpoenas or discover material facts essential to the accident investigation. Osborne also alleges in his complaint that "traditional discovery procedures" are unavailable to him due to no action being filed. 

Osborne seeks all appropriate relief. He is represented by Richard Jurewicz and Brooke Elmi of Galfand Berger LLP in Philadelphia.
