PITTSBURGH — Construction workers on the Pennsylvania Petrochemical Complex, known as the Shell Cracker Plant, in the western part of the state are claiming they did not receive overtime pay.
Daniel Davidson, on behalf of himself and all others similarly situated, filed a complaint Nov. 2 in the Court of Common Pleas of Allegheny County against Brand Industrial Services Inc., BrandSafway Industries and others alleging violation of the Pennsylvania Minimum Wage Act.
Davidson alleges in his complaint that he was working for the defendants, who were contracted by Shell Oil for construction of the Pennsylvania Petrochemical Complex between August 2019 and June of 2021, as a carpenter. He alleges that he and other workers continue to work for the defendants in excess of 40 hours per week without receiving overtime pay.
Davidson further alleges that the defendants also ran a "scheme" in which they failed to pay workers for "compensable work activities" that they performed after clocking out such as traveling from the time clock location to the bus, waiting for the bus and the bus ride back to the employee parking lot. He claims the defendants' failure to pay overtime compensation is in violation of the Pennsylvania Minimum Wage Act.
