Lawsuit: Man suffers fractured femur after tripping over wooden pallet at Busy Beaver

PITTSBURGH — A man alleges he suffered a fractured femur after falling over a protruding wooden pallet at a store in Greenville. 

Albert Wayne Durniok, Jr., filed a complaint Nov. 22 in the Court of Common Pleas of Allegheny County against Busy Beaver Building Centers Inc., doing business as Busy Beaver of Greenville, alleging negligence. 

Durniok claims in his suit that he was at the Busy Beaver store on Hadley Road in Greenville on March 15, 2021. He alleges that a baseboard display was displayed "in such a way to divert the eye of the invitees up," which caused him not to notice a protruding wooden pallet. 

Durniok claims the protruding pallet caused him to fall "violently" to the ground and to suffer serious and permanent injuries including a fractured femur which required a hip replacement, injuries to his calf and leg as well as bruises and contusions. He further claims the defendant's negligence for failing to cordon off the dangerous condition or warn of the hazard. Durniok also claims the defendant failed to regularly inspect the area and make its premises safe. 

Durniok seeks monetary relief, interest and trial by jury. He is represented by Paul Mayer of Friday & Cox LLC in Pittsburgh.
