Suit: Step stool collapse caused worker's fall, rotator cuff injury

PITTSBURGH — A worker who allegedly suffered injuries when a step stool collapsed is claiming negligence. 

Rosemarie Batista filed a complaint Dec. 6 in the Court of Common Pleas for Allegheny County against Wanda Scott alleging negligence.

Batista alleges in her complaint that while working as an employee of Scott, on Dec. 16, 2019, she was asked to decorate a Christmas tree on the premises located on Thomas Street in Monroeville. She claims that the bottom of the step stool/ladder she was given fell out from underneath, toppled over and caused her to fall. She claims Scott's negligence for failing to properly secure and stabilize the stool or to warn her of the risk involved in climbing the stool. 

Batista also claims the defendant failed to inspect and maintain the step stool to keep it in a reasonably safe condition and also did not properly supervise her while she was using the stool. She alleges as a result of falling off the stool, she suffered a rotator cuff tear, arm and shoulder pain and a contusion. She also alleges she suffered loss of income and incurred medical treatment expenses. 

Batista seeks monetary relief of more than $50,000, interest, trial by jury and all other just relief. She is represented by Michael T. van der Veen of Van Der Veen, Hartshorn & Levin.
