Former inmate alleges abuse by Philadelphia officers

PHILADELPHIA — A former City of Philadelphia corrections inmate alleges he was beaten by officers.

Victor Hernandez filed a complaint Jan. 5 in U.S. District Court for the Eastern District of Pennsylvania against City of Philadelphia and others alleging civil rights violations, excessive force and other claims. 

According to his complaint, Hernandez was an inmate at Curran Fromhold Correctional Facility on Oct. 6, 2020. He claims that he was attacked by the corrections officers during a dispute between inmates in his pod over the phone system. 

Specifically, Hernandez alleges he was taken to a new cell and given a strip search and that the defendant corrections officers beat him and caused him to suffer injuries. He claims he suffered a ruptured testicle which required surgery, a blood clot, rib fracture and a facial wound. Hernandez also claims the defendants falsely alleged a violation against him which caused him to be returned to "the hole" once he returned from the hospital. 

He alleges the defendants' behavior violated his constitutional rights and that the City of Philadelphia knew or should have known about its employees' illegal conduct. 

Hernandez seeks monetary relief of more than $150,000, trial by jury and all other just relief. He is represented by Brian Zeiger of Levin & Zeiger LLP in Philadelphia.
