Tenant who fell over open drain hole at apartment complex claims negligence

MEDIA — A tenant is alleging negligence after his foot became caught in an open drain hole in a stairwell of his apartment complex.

Carl H. Thevenin filed a complaint Jan. 12 in the Court of Common Pleas of Delaware County against Rentwell LLC and Christian Somerville alleging negligence. 

Thevenin, according to his complaint, was a tenant at the defendant's apartment complex on Aug. 5, 2020. He alleges that as he was walking down a stairwell to the basement laundry facility, his foot became caught in an open drain hole in the middle of a cement stairwell, which caused him to fall. 

Thevenin claims he suffered a fractured toe and other injuries as a result of the accident. He further claims the defendant's negligence for failing to maintain the stairwell, cement steps and open drainpipe in a safe condition; failing to inspect the area; and failing to warn of the open drain. 

Thevenin seeks monetary relief of more than $50,000 and all other just relief. He is represented by Peter Mylonas of the Law Offices of Peter George Mylonas PC in Broomall.
