PITTSBURGH — A bar customer alleges he was violently attacked by another patron who was intoxicated and suffered permanent brain damage.

Joseph Soldano filed a complaint April 20 in the Court of Common Pleas of Allegheny County against Krazy Karen's LLC doing business as Krazy Karen's Cafe & Galleria alleging negligence.

According to his suit, Soldano was at Krazy Karen's Cafe & Galleria on Noblestown Road in Pittsburgh on May 1, 2021. He alleges that a patron who was "visibly agitated and or intoxicated" and was displaying aggressive "and potentially violent behavior" struck him in the face and head.

Soldano claims he suffered a fractured skull, brain bleed, concussion and post-concussion syndrome. He also claims he suffered permanent brain damage including permanent loss of taste and smell.

Soldano alleges the defendant's negligence for failing to protect patrons, allowing a visibly intoxicated person on the premises, failing to warn of the threat of harm and for failing to properly assess the condition or have proper policies in place to prevent altercations. He also alleges the defendants were negligent for failing to adequately supervise its employees or have sufficient employees to prevent the dangerous condition.

Soldano seeks monetary relief of more than $50,000, trial by jury and all other just relief. He is represented by Gary Ogg of Ogg, Murhpy & Perkosky PC in Pittsburgh.
