In the Court of Common Pleas of Allegheny County, Pennsylvania, Robert S. Gano, as Administrator of the Estate of Elaine L. Gano, filed a lawsuit against Dr. Tulio Estrada-Quintero and University of Pittsburgh Physicians trading as UPMC Heart and Vascular Institute. The case ID is not provided in the document, and it was filed on September 13, 2023.

The complaint alleges that on May 12, 2022, Elaine L. Gano fell off an examination table during a routine cardiology appointment with Dr. Estrada-Quintero at UPMC Heart and Vascular Institute. This fall resulted in severe injuries including a completely displaced fracture of her proximal humerus diaphysis and subsequent complications such as facial cellulitis requiring hospitalization and surgery. Mrs. Gano’s condition deteriorated following these events until her death on April 11, 2023.

Represented by attorneys Katie A. Killion and Anthony C. Mengine from Kontos Mengine Killion & Hassen, the plaintiff claims professional negligence against both defendants for failing to properly supervise Mrs. Gano during her medical visit which led to her injuries and eventual death. The damages sought include medical expenses, funeral costs, loss of companionship, and other related losses under Pennsylvania's Wrongful Death Act and Survival Act.

The plaintiff seeks judgment in favor of the estate for an amount exceeding the jurisdictional limits of arbitration plus costs.
