Plaintiff Alleges Negligence Against PennDOT Facility Over Hazardous Condition

A dangerous and defective condition at a Pennsylvania Department of Transportation (PennDOT) facility has led to a civil lawsuit. Theresa Lee filed the complaint in the Court of Common Pleas, Delaware County, on an unspecified date against the Pennsylvania Department of Transportation-Driver License Center-Granite Run, Penndot District 6-Delaware, BT Granite Run LP, BT Granite Run GP, LLC, and other associated entities.

The case stems from an incident on June 22, 2022, when Theresa Lee visited the DMV located at 1067 W. Baltimore Pike in Media, Pennsylvania. According to the complaint, Lee encountered an improperly placed and/or secured mat at the entrance of the facility that caused her to fall and sustain injuries. The defendants are accused of negligence for allowing this hazardous condition to exist for an unreasonable period. "The aforesaid accident was due solely to the negligence and carelessness of the Defendants," states the complaint.

Lee's injuries include wrist sprain and strain along with musculoskeletal injuries which have resulted in significant pain and suffering. The plaintiff alleges that these injuries have required medical attention and will continue to necessitate such care indefinitely. Furthermore, Lee claims she has suffered a severe loss of earnings and impairment of earning capacity due to her injuries.

The complaint outlines several accusations against the defendants including failure to correct known dangerous conditions, improper design and maintenance of interior matting, violation of local building codes, and failure to warn visitors about potential hazards. Specific allegations include "failing to ensure that interior matting was properly secured" and "permitting a highly dangerous condition to exist for an unreasonable time."

Theresa Lee is seeking judgment against all named defendants jointly or severally for damages not exceeding arbitration limits plus interest and costs. The relief sought includes compensation for medical expenses incurred as well as future medical costs related to her injuries. Additionally, she seeks compensation for lost earnings and impairment of earning capacity.
