Local Business Accused of Negligence Leading to Severe Injuries

A recent court filing in Allegheny County, Pennsylvania, has brought to light serious allegations of negligence against a local business and its property management company. The complaint was filed by Diana Wagner on July 23, 2023, naming Irish Design Center, Delta Property Management, Tom Petrone, and Maura Krushinski as defendants.

According to the complaint filed by attorney Laura R. Signorelli of Morgan & Morgan Philadelphia, PLLC, Diana Wagner alleges that she sustained severe injuries due to unsafe conditions on the premises managed by the defendants. The incident occurred at 303 S. Craig Street in Pittsburgh, where Wagner claims she tripped over a broken sidewalk that was neither painted nor marked to indicate its hazardous state. As a result of this fall, Wagner suffered a right distal fibula fracture and a broken right ankle among other injuries.

The lawsuit details that Irish Design Center and Delta Property Management were responsible for maintaining the premises, including the parking lot, sidewalks, and walkways. It asserts that these entities failed in their duty to inspect and maintain safe conditions or provide adequate warnings about potential hazards. "Defendants had the duty and responsibility to inspect and maintain the Premises to discover and remediate any dangerous, hazardous, and/or unsafe conditions located thereon," states the complaint.

Wagner's complaint outlines multiple counts of negligence against each defendant. These include failing to paint or mark the edge of the sidewalk conspicuously, not providing warnings about the dangerous condition of the walking surfaces, neglecting timely inspections for hazards, and not taking adequate measures to ensure public safety on their property. Specifically noted is their failure "to timely position a warning sign or device in an area where it could be observed before invitees came into contact with the broken sidewalk."

The plaintiff is seeking compensatory damages exceeding Allegheny County's arbitration limits for her pain and suffering as well as medical expenses incurred due to her injuries. She argues that her general health has been impaired significantly and she has endured great pain which will continue into the future.
