Nursing Home Accused of Negligence Leading to Resident's Death

A lawsuit has been filed against a nursing home for alleged negligence that led to the death of an elderly resident. Jasmine Hendri Montecarlo, as the administrator and personal representative of the estate of Carmella LaBruna, filed the complaint in the Court of Common Pleas in Delaware County on July 5, 2024, naming Yeadon Operations LLC and other associated entities as defendants.

The case revolves around allegations that Yeadon Rehabilitation and Nursing Center failed to provide adequate care to Carmella LaBruna, who was admitted to the facility on January 31, 2022. LaBruna had a medical history including dementia, insomnia, hypertension, hearing loss, muscle weakness, and a history of falling. Despite being identified as a fall risk from her admission date, she suffered multiple falls during her stay at Yeadon. These incidents included a broken hip on February 27, 2022; additional falls on March 11, April 2, June 3; another fall on September 9; and two more falls in October resulting in a non-displaced fracture of her left elbow.

Montecarlo alleges that the facility's negligence continued unabated despite these incidents. On June 28, 2023, LaBruna suffered another fall which resulted in significant head injuries. Montecarlo discovered her grandmother with one eye completely swollen shut due to the fall when she visited later that day. The injury had not been treated properly—no ice had been applied or ordered. Following this incident, LaBruna was transferred to Taylor Hospital for treatment but her condition deteriorated rapidly thereafter. She passed away on August 15, 2023.

The plaintiff claims that these injuries and subsequent deterioration were clinically avoidable if consistent care adhering to accepted standards and regulations had been provided by Yeadon Rehabilitation and Nursing Center. The lawsuit accuses the defendants of failing to implement adequate care plans for LaBruna’s needs and neglecting proper measures to mitigate her risk of falling. It also cites failures in providing necessary emergent medical care following her injuries and maintaining appropriate supervision.

Montecarlo is seeking compensatory damages exceeding $50,000 for both wrongful death and survival action claims. The lawsuit demands judgment against all named defendants jointly and severally for their alleged breaches of duty leading to LaBruna’s suffering and eventual death.
