Business Invitee Sues Major Petroleum Company Over Negligence Leading to Severe Injuries

A business invitee has filed a lawsuit against a major petroleum company and its associated entities, alleging negligence that led to severe personal injuries. Lisa C. Morris lodged the complaint in the Court of Common Pleas of Allegheny County, Pennsylvania, on an unspecified date against Marathon Petroleum Company LP, Majors Management LLC d/b/a Marvin Hewitt, and MM PA Properties LLC.

According to the complaint, Morris was injured on August 7, 2022, while traversing the parking lot of a gas station and convenience store operated by the defendants at 150 US-30 in Oakdale, Allegheny County. The plaintiff claims that she encountered an "uneven, broken, deteriorated, and defective parking lot," which included an unmarked depression that caused her to fall violently to the ground. As a result of this fall, Morris sustained severe injuries including tearing of ligaments in her left ankle and fractures in her left distal fibula and lateral malleolus.

The lawsuit alleges that the defendants were negligent in their duty to inspect, maintain, repair, control, supervise, and oversee the premises. Specifically, it accuses them of failing to make reasonable inspections that would have revealed the dangerous condition of the parking lot. The complaint also highlights a lack of signage or other warnings about the hazardous condition and neglect in fixing or remedying it.

Morris asserts that her injuries were exclusively caused by the defendants' negligence and recklessness. She details various failures on their part such as allowing the premises to degrade into an unsafe condition for an unreasonable period of time and not providing adequate safety precautions or timely repairs. The plaintiff further claims that these failures have resulted in significant physical pain, mental anguish, medical expenses, loss of income, and impairment of her earning capacity.

In terms of relief sought from the court, Morris is asking for judgment against all defendants for damages exceeding compulsory arbitration limits. She is also seeking court costs, interest, and any other relief deemed just and equitable by the court.
