Plaintiff sues Healthcare Facility Over Negligence Leading To Severe Injuries

A Pittsburgh woman has filed a lawsuit against two companies, alleging negligence that led to severe injuries. Laurell Harbour lodged the complaint in the Court of Common Pleas of Allegheny County, Pennsylvania, on June 28, 2024, naming Da Vita Kidney Care and REA Ventures II Limited Partnership as defendants.

According to the court documents, Harbour claims she suffered significant injuries due to unsafe conditions in the parking lot of Da Vita Kidney Care's facility at 5171 Liberty Avenue, Pittsburgh. On November 6, 2023, at approximately 6:00 a.m., Harbour parked her vehicle in the lot and was walking towards the facility for dialysis treatment when she tripped over an unmarked change in elevation. The fall caused her to slam into a parked car and subsequently hit her head and body on the concrete ground. The complaint states that Harbour sustained multiple injuries including right knee surgery, head injury, right leg injury, left foot toe injury, right shoulder injury, face scratches, severe pain, difficulty walking, decreased range of motion, weakness, numbness and tingling, swelling, bruising, scarring and disfigurement.

Harbour alleges that both Da Vita Kidney Care and REA Ventures II Limited Partnership were aware of the hazardous condition but failed to take necessary actions to rectify it or warn invitees like herself. The plaintiff argues that the defendants had a duty to inspect and maintain their premises to ensure safety for all visitors. She accuses them of negligence for allowing dangerous conditions to persist without adequate warnings or repairs.

The lawsuit outlines several specific failures by the defendants: permitting unsafe walking surfaces and transitions from parking lot to sidewalk; not placing warning signs; failing to inspect and maintain safe conditions; not barricading hazardous areas; neglecting proper training for employees regarding safety inspections; violating applicable guidelines for commercial property maintenance; among others.

Harbour is seeking compensatory damages exceeding the arbitration limits of Allegheny County. She requests compensation for medical expenses incurred due to her injuries as well as future medical costs. Additionally, she seeks damages for pain and suffering, loss of enjoyment of life, past and future wage loss or impairment of earning capacity, embarrassment and humiliation.
