Customer sues retail giant Marshalls over slip-and-fall injury

A woman has filed a lawsuit against a well-known retail chain, alleging negligence after suffering severe injuries from a slip and fall incident at one of their stores. Lois Grasberger filed the complaint in the Court of Common Pleas of Delaware County on July 11, 2024, naming Marshalls and its parent companies as defendants.

According to the complaint, Grasberger was shopping at the Marshalls store located at 400 S State Road in Springfield, PA, on August 1, 2022. She claims that she slipped on a wet and slippery substance on the sales floor immediately after exiting the fitting room area. The plaintiff alleges that this hazardous condition was due to the negligence of Marshalls and its operating entities—Marmaxx Operating Corp. and The TJX Companies, Inc.—who failed to maintain safe premises for their customers.

The lawsuit details several accusations against the defendants. It states that they were negligent in allowing a dangerous condition to exist by not properly inspecting or maintaining the area where Grasberger fell. "Defendants failed to make a reasonable inspection of the floor, which would have revealed the dangerous condition created by the wet slippery substance," reads one part of the complaint. Furthermore, it accuses them of failing to warn customers about the hazard or taking any safety precautions such as erecting barricades or cleaning up the spill.

Grasberger asserts that as a result of this negligence, she suffered multiple injuries including a concussion with post-concussive syndrome, thoraco-lumbar contusion, sprain and strain, aggravation of pre-existing conditions, and post-traumatic lumbar radiculitis. She also claims these injuries have led to severe physical pain and mental anguish which may continue indefinitely into the future.

In her filing, Grasberger is seeking judgment against all defendants jointly and severally for an amount exceeding $50,000. She demands compensation for medical expenses incurred due to her injuries as well as future medical costs. Additionally, she seeks damages for pain and suffering, permanent disability or impairment of earning capacity, loss of life's pleasures, and potential future income loss.
